Consider the consequences...
Victimless crimes may be followed by unrealistic penalties. The real penalty follows with the "Have you ever been to prison?" Question, which is bad enough, then consider the "Please explain the circumstances" essay question that would follow.
Really, the only thing worse would be having it come out later...
